About the Bar Exams

Overview
New York States’ Bar Exams are given over a Two-Day period consisting of  Multistate Bar Examination (MBE)
Essays specific to each state’s laws – some states use the Multistate Essay Examination (MEE)
California State examines candidates over a Three-Day period.
The Multistate Performance Test (MPT) is tested.
Prospective attorneys will have to pass the Multistate Professional Responsibility Examination (MPRE)

Essay Day  

The essay day normally precedes the MBE and is generally given on a Tuesday
In California there are two essay days; a candidate will be given:
Three essays on the morning of the day before the Multistate Examination Day.
Three essays on the on the morning after the Multistate Examination Day.

New York uses the Multistate Performance Test (MPT) and the Multistate Essay Examination (MEE) and they are tested on the essay day

Multistate Bar Examination (MBE) Day
This examination is a 200-question (10 of which are test questions and are not counted)multiple choice exam  given in 48 states on the same day:

The last Wednesday in February
The last Wednesday in July
The MBE is the same examination given in all (48) states

The subjects tested are:

  • Contracts/Sales – 33 questions
  • Torts – 33 questions
  • Real Property – 31 questions
  • Evidence – 31 questions
  • Constitutional Law – 31 questions
  • Criminal Law and Procedure – 31 questions

New York and California require candidates to write essays on the day preceding the Multistate Bar Examination (MBE) in state-specific subjects.  New York and Califonia usually test on general majority rule subjects.

NCBE MBE Questions

NCBE made the 1992 MBE (581 questions) and July 1998 MBE (200 questions) available as free downloads. These exams can be downloaded here: http://www.ncbex.org/multistate-tests/mbe/

The 1992 book consists of 531 previously published questions and 50 questions from the Feb 1991 MBE (questions 532-581). Please note NCBE’s disclaimer:

The 581 questions contained in this document appeared on MBEs administered between 1972 and 1991. Because of their dated nature, many of the questions may test principles that have been altered by changes in the law and thus are no longer suitable topics to be tested. As a result, some of the answers shown in the answer key may be incorrect under currently accepted principles of law. Further, many of these questions do not reflect the current style of MBE questions, and a number of the questions appear in formats that are no longer used on the MBE.

The questions and answers in this document are provided only for the purpose of providing applicants with a sample of the range and general format of questions that appeared on previously administered MBEs, not as examples of the content currently tested or of the material to be studied for the substance of the examination. Many of these questions are currently in use, sometimes with alteration, by commercial bar review courses under a licensing arrangement with NCBE. Because these questions are available in the marketplace, NCBE is choosing to make them available online.

These study aids, which include explanations for each option selected, contain questions from more recently administered MBEs that more accurately represent the current content and format of the MBE.

Practicing as a solicitor in England and Wales as a qualified lawyer from overseas

Stage one Qualified within the EU
If you are a qualified lawyer in any member state of the EU Rule 15 (Overseas practice) and rule 16 (European cross-border practice) of the Solicitors’ Code of Conduct explain the conduct requirements for Registered European Lawyers (RELs).

Qualified outside of the EU
In order to practise as a solicitor in England and Wales, you must sit the Qualified Lawyers Transfer Test (QLTT). The QLTT is a conversion test that enables lawyers qualified in certain countries outside England and Wales (such as the US, Israel, Australia, Nigeria, India and South Africa), as well as UK barristers, to qualify as solicitors.

Before entering for the QLTT Test, you must first obtain a Certificate of Eligibility from the Law Society of England and Wales.

This will confirm which Heads of the test you must pass, together with any requirement for further training. This can take six to eight weeks to process. This will vary according to the primary jurisdiction of the applicant.

The Solicitors Regulation Authority is currently reviewing requirements for overseas lawyers, but as of March 2008, lawyers from outside the European Union are required to satisfy the Law Society that they have gained two years of common law experience within the past five years. Such experience must have been undertaken in three areas of common law, and must have covered contentious and non-contentious areas of practice.

If you are not eligible to sit the QLTT, then you will need to follow the route to qualification as a non-law student. You access the website of the International Bar Association to find out more about qualifying as a Solicitor or Barrister in the United Kingdom.

Every day in the legal press, you will read about UK firms opening offices in new countries and merging with overseas firms to further increase their international dominance. In addition many international firms are also opening offices in the UK as it offers a bridge from the US to mainland Europe and beyond. The UK legal market has been and will continue to expand both rapidly and globally and UK firms need the experience and language skills non-UK nationals can offer.

Qualify as a Solicitor in Ireland for Overseas Qualified Lawyers

The options available to lawyers, with a qualification from outside of the Republic of Ireland, who want to practice in this jurisdiction.

Overview
The Qualified Lawyers Transfer Test (QLTT) is a conversion Test which enables lawyers qualified in certain countries outside the Republic of Ireland, to qualify as solicitors in this jurisdiction. There are two sittings of the Test each year – usually Summer and Winter- at the Law Society’s offices in Dublin.

Certificate of Eligibility
Before entering for the QLTT examination, you must first obtain a Certificate of Eligibility from the Law Society’s Education Committee.  www.lawsociety.ie

IRISH LAW SOCIETY ENTRANCE EXAMINATIONS – FE 1
This is the route to be followed if you qualified as a Solicitor/Barrister outside of the European Union.
Below are the following Steps to qualification as a solicitor:

  1. The Preliminary Examination (for non-Graduates)
  2. The Final Examination – First Part (entrance examination)
  3. The Training Contract (24 months in duration)
  4. The Professional Practice Courses (PPC I & PPC II)


About the FE-1 Exam

The Final Examination – First Part (FE-1) is the entrance examination to the Law Society of Ireland. Only those who have passed or gained exemption from the Preliminary Examination can sit this examination. It  is held twice a year, normally in Spring and Autumn.

It consists of the following eight papers:

  • Company Law
  • Constitutional Law
  • Law of Contract
  • Criminal Law
  • European Union Law 
  • Equity
  • Real Property
  • Law of Tort

KINGS INN ENTRANCE EXAMINATIONS 

ENTRANCE EXAMINATION FOR ADMISSION INTO THE BARRISTER AT LAW DEGREE COURSE IN THE REPUBLIC OF IRELAND

Admission as a student to the degree course is by an entrance examination. To be eligible to sit this examination a candidate must have submitted a satisfactory student admission declaration together with a transcript of all degree/diploma results on or before 1 July in the year in which an applicant intends to take the examination. Moreover, an applicant should hold either an approved law degree/approved postgraduate diploma or the Society’s Diploma in Legal Studies.

The student admission declaration together with the list of approved third level degrees may be found in the prospective student area of  www.kingsinns.ie.

The applicant must show that, in the course leading to the approved degree/postgraduate diploma, he/she has passed the following core subjects as required by the Society:

• Land Law (including the Law of Succession)
• Equity
•Jurisprudence
• Company Law
• Law of the European Union
• Administrative Law

The Application process

Application forms for the entrance examination together with the student admission declaration are available on the website. The closing date for receipt of application is 31 may. The application form must be submitted electronically. The student admission declaration must be signed and delivered to King’s Inns along with transcripts of degree results on or before 1 July in the year in which an applicant intends to take the examination.

All candidates should be familiar with the rules relating to the entrance examination.  Information  regarding marks and standards, deferrals, eligibility to re-sit, dates of examinations along with all the education rules may be found in the prospective student area of the website.

Acceptance of offers
Offers of places on the degree course must be accepted in accordance with the time frame laid down by King’s Inns. Candidates to whom places are allocated will be notified as soon as is practicable. Such candidates will be required to submit an acceptance form and the appropriate fee within a specified period.
